These Terms are in addition to any engagement agreement, fee agreement, or other written contract entered into between you and TrustFully in connection with the provision of legal services. In the event of any conflict between these Terms and a signed engagement agreement, the engagement agreement controls.

This Website is owned and operated by STL Estate Plan, LLC, a Missouri limited liability company operating under the trade name TrustFully. Our principal place of business is located at 401 Pine St, Saint Louis, Missouri 63102.

TrustFully provides estate planning, business planning, probate, guardianship, Medicaid planning, and related legal services to clients in Missouri. Derek Haake is the licensed Missouri attorney responsible for the legal services provided by TrustFully and the content published on this Website.

7. SMS / Text Messaging Terms and Conditions

This section governs TrustFully’s SMS text messaging program and satisfies the messaging terms requirements of The Campaign Registry (TCR), CTIA guidelines, RingCentral’s SMS/MMS Content Policies, and the Telephone Consumer Protection Act (TCPA). These Messaging Terms are incorporated into and form part of these Terms and Conditions.

Program description. TrustFully uses RingCentral, a TCR-registered Campaign Service Provider, to send SMS text messages to clients and prospective clients who have explicitly opted in to receive them. Messages relate to appointment reminders, consultation confirmations, scheduling updates, case communications, and responses to inquiries. TrustFully does not send unsolicited marketing text blasts.

Opt-In. When you opt in to TrustFully’s SMS program, we will send you a confirmation message. By opting in, you agree to receive recurring text messages from TrustFully at the mobile number you provided. Opt-in may occur through:

  • Checking the optional SMS consent checkbox on our website contact or intake form
  • Verbally consenting during a phone consultation, with confirmation by SMS
  • Texting TrustFully directly at (314) 732-1547, which constitutes consent to an SMS response

Consent is not a condition of purchase or service. Your consent to receive SMS messages is entirely optional and is not required to engage TrustFully for legal services or to use any feature of this Website.

Message frequency. Message frequency varies based on your interaction with TrustFully. TrustFully reserves the right to adjust message frequency at any time. Additional messages may be sent based on the status of your matter or your direct requests. Your mobile provider is not liable for delayed or undelivered messages, and carriers are not responsible for message delivery.

Cancellation / Opt-Out. You may cancel your enrollment in TrustFully’s SMS program at any time by replying to any TrustFully message with any of the following keywords: STOP, UNSUBSCRIBE, QUIT, CANCEL, or END. After receiving your opt-out request, TrustFully will send you a single confirmation message and no further text messages will be sent to your number unless you affirmatively re-subscribe.

Transfer of number. Before changing your mobile number or transferring your mobile number to another individual, you agree to either: (a) reply STOP from the original number; or (b) notify TrustFully at support@trustfully.law with your old number. This obligation is a condition of your participation in the TrustFully SMS program.

No purchased lists. TrustFully does not send SMS messages to lists purchased from third parties or generated by third-party lead sources. We only message individuals who have actively and explicitly consented to receive messages from TrustFully.

Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to network availability and your carrier’s terms of service.

Privacy. Your mobile number and SMS opt-in information are handled in accordance with our Privacy Policy. Your mobile number will not be shared with third parties for their own marketing purposes. SMS data may be processed by RingCentral as our messaging platform and registered with The Campaign Registry (TCR) as required for carrier compliance.

Changes to Messaging Terms. TrustFully reserves the right to change or terminate the SMS messaging program at any time. TrustFully also reserves the right to update these Messaging Terms at any time. Changes are effective immediately upon posting. If you do not agree to updated Messaging Terms, you should opt out of the SMS program by replying STOP. Your continued participation in the program following any posted change constitutes your acceptance of that change. TrustFully also reserves the right to change the phone number or sender identification from which messages are sent.
