SMS / Text Message Program — Important Notice

TrustFully uses RingCentral to send SMS text messages to clients and prospective clients who have explicitly opted in to receive them. This policy has been updated to satisfy The Campaign Registry (TCR) registration requirements, CTIA guidelines, and TCPA compliance standards applicable to business SMS messaging. See Section 5 — SMS Text Messaging Program for the complete disclosure.

1. About Us

“We,” “us,” or “our” means STL Estate Plan, LLC, operating as TrustFully, with its principal place of business at 401 Pine St, Saint Louis, MO 63102. TrustFully is a Missouri-licensed law firm providing estate planning, business planning, probate, guardianship, and related legal services.

2. About This Privacy Policy

Your privacy is important to us. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you use our website, contact us by phone, email, or text message, or engage us for legal services (collectively, the “Services”).

This policy has been updated to include disclosures required by The Campaign Registry (TCR), CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (TCPA), and RingCentral’s SMS/MMS Content Policies applicable to our use of RingCentral for business text messaging.

3. What Personal Information We Collect and How We Collect It

We collect personal information that you provide directly to us:

Contact information. If you contact us, request a consultation, subscribe to communications from us, or opt in to receive text messages, we collect your name, email address, mailing address, phone number (including mobile number), and any other information needed to communicate with you about our Services.

SMS opt-in information. If you consent to receive text messages from TrustFully, we collect and log your mobile phone number, the date and method of your consent, and the specific types of messages you agreed to receive. This consent record is maintained separately and is not shared with third parties for their direct marketing purposes. See Section 5 for complete SMS program disclosures.

Payment information. To engage our services, you may provide payment information. Your financial information is collected and stored by a third-party payment processor. Use and storage of that information is governed by the payment processor’s applicable privacy policy.

Survey and intake information. We collect information you provide through consultation intake forms, questionnaires, client feedback, or other features of the Services.

Communications information. We collect information from your communications with us — including emails, phone calls, and text messages — such as your questions, preferences, and the content of your inquiry. Text messages sent to and from our business number through RingCentral are subject to RingCentral’s privacy practices in addition to this policy.

Automatically collected information. When you visit our website, we automatically collect certain technical information including your IP address, browser type, operating system, pages visited, and referring URL. We use this information to analyze website performance and improve the Services. We may use cookies and similar tracking technologies; you may control cookie settings through your browser.

4. How We Use Your Personal Information

We use the personal information we collect for the following purposes:

  • To respond to your consultation requests, questions, and inquiries
  • To communicate with you about your legal matter or engagement with TrustFully
  • To send you SMS text messages for which you have provided explicit consent (see Section 5)
  • To send you newsletters, legal updates, or other information about our Services that you have requested or consented to receive
  • To send you non-promotional notices, updates, security alerts, and administrative messages related to your engagement with us
  • To monitor and analyze usage trends and improve the Services
  • To carry out our obligations arising from any engagement agreement between you and TrustFully, including billing and collection
  • To detect, investigate, and prevent fraudulent transactions or other illegal activities and to protect the rights and property of TrustFully and its clients
  • To comply with applicable law and professional responsibility obligations

We will not use your personal information for any purpose that is inconsistent with this Privacy Policy or our professional responsibilities as a law firm. We will not sell your personal information.

5. SMS Text Messaging Program

TrustFully uses RingCentral, a registered Campaign Service Provider (CSP), to send SMS text messages to clients and prospective clients. This section provides the full disclosures required by The Campaign Registry (TCR), CTIA guidelines, and the TCPA for our SMS messaging program. By opting in to receive text messages from TrustFully, you agree to the terms described in this section.

  • Message types: Appointment reminders, consultation confirmations, case status updates, scheduling communications, and responses to your inquiries. We do not send unsolicited promotional or marketing messages via SMS.
  • Message frequency: Message frequency varies. You will only receive messages directly related to your consultation, engagement, or inquiry. We do not send broadcast marketing text blasts.
  • Charges: Message and data rates may apply based on your mobile carrier’s plan. TrustFully does not charge for SMS messages.
  • Opt-out: Reply STOP to any message to unsubscribe from all future text messages. You may also text UNSUBSCRIBE, QUIT, CANCEL, or END — all of these keywords will immediately remove you from our SMS list.
  • Help: Reply HELP to any message for assistance. You may also contact us at support@trustfully.law or (314) 732-1547.
  • Privacy: Your mobile phone number and SMS consent information will not be shared with third parties for their marketing purposes. See below for our full data handling disclosure.

How we obtain your consent. We only send SMS text messages to individuals who have explicitly opted in. Consent may be obtained in one of the following ways:

  • By checking an optional, unchecked-by-default SMS consent checkbox on our website contact or intake form. The consent language on that form reads: “I consent to receive SMS text messages from TrustFully regarding my consultation, appointment, or inquiry. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for help. Privacy Policy: [link]”
  • By verbally consenting during a phone consultation, with confirmation sent via SMS
  • By texting us directly at (314) 732-1547, which constitutes consent to receive a response via SMS

Consent is not a condition of service. You are not required to consent to receive SMS messages in order to engage TrustFully or use any of our Services. Consent to SMS is entirely optional.

Implied consent is not sufficient. We do not treat providing a phone number alone, or purchasing a service from us, as consent to receive SMS messages. A separate, affirmative opt-in is required before we will send text messages.

We do not use purchased lists. We do not send SMS messages to lists purchased from third parties or generated by third-party lead sources. We only message individuals who have actively consented to receive messages from TrustFully specifically.

How to opt out. You may opt out of TrustFully SMS messages at any time by replying to any text message with one of the following keywords:

  • STOP — removes you from all TrustFully text message communications immediately
  • UNSUBSCRIBE, QUIT, CANCEL, or END — all treated as opt-out requests

Upon receiving your opt-out request, you will receive a single confirmation message and no further text messages will be sent unless you choose to re-subscribe by replying START.

Data privacy for SMS. Information collected through your SMS opt-in — including your mobile number, consent record, and message history with TrustFully — is used only for the purpose of sending the messages you consented to receive and for compliance documentation. We do not sell, rent, or share your mobile number or SMS consent information with third parties for their direct marketing purposes. Your SMS data may be shared with RingCentral as our SMS delivery platform and with The Campaign Registry (TCR) as required for carrier compliance registration. These parties are bound by their own privacy policies and applicable telecommunications law.

RingCentral automatic opt-out handling. RingCentral automatically processes opt-out keywords (STOP, UNSUBSCRIBE, QUIT, CANCEL, END) and will immediately cease sending messages from our number to any number that sends an opt-out keyword. Opt-in re-engagement is available by replying START to our number after opting out.

Carrier support. Carrier message delivery is not guaranteed. TrustFully is not responsible for delays or failures in message delivery caused by your mobile carrier or network conditions.

7. How We Share Your Personal Information

We may share your personal information in the following limited ways:

Service providers. We share personal information with vendors, consultants, and service providers who process information on our behalf — including our practice management platform, scheduling tools, payment processors, email service providers, and RingCentral (our SMS communications platform). These parties are permitted to use your information only as needed to provide services to us and are bound by appropriate confidentiality and data protection obligations.

SMS platform. Your mobile number and related SMS consent and message data are processed by RingCentral as our SMS delivery platform and registered with The Campaign Registry (TCR) as required for carrier compliance. TrustFully does not share your mobile number or SMS opt-in status with any third party for their own marketing purposes.

Business transfers. In connection with a merger, acquisition, sale of assets, or other business transaction, personal information may be transferred as part of that transaction. We will notify you of any such transfer that materially affects the handling of your personal information.

Legal requirements. We may be required to disclose personal information to comply with applicable law, a court order, subpoena, or lawful request from a government authority. We will only make such disclosures where we have a good-faith belief that disclosure is legally required and, where permitted, we will notify you of such a request.

Professional responsibility. As a law firm, TrustFully is subject to Missouri Rules of Professional Conduct governing the confidentiality of client information. Information shared with us in the context of a legal engagement is subject to attorney-client privilege and applicable professional conduct rules in addition to this Privacy Policy.

8. Your Marketing Choices

We will send marketing or informational messages to you only if you have asked us to do so, have engaged our services, or have separately consented to receive such communications.

Email marketing. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link included in each marketing email or by contacting us at support@trustfully.law. Unsubscribing from marketing emails will not affect delivery of transactional or case-related communications.

SMS / text messages. You may opt out of text messages at any time by replying STOP to any text message from TrustFully, or by contacting us at support@trustfully.law or (314) 732-1547 and requesting removal. See Section 5 for complete opt-out instructions.

We will ask for your consent before sharing your personal information with any third party for their direct marketing purposes. We do not currently share personal information with third parties for their own marketing.

9. Retention of Your Data and Deletion

Your personal information will not be kept longer than is necessary for the specific purpose for which it was collected, subject to our legal and professional responsibility obligations.

When we determine how long to retain your information, we consider the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purpose for which it was collected; and any applicable legal requirements, including Missouri Rules of Professional Conduct and general legal retention standards applicable to law firm client files.

SMS opt-in and opt-out records are retained for a minimum of four years from the date of consent or opt-out, consistent with TCPA statute of limitations requirements for SMS compliance documentation.

We may retain personal information beyond the above periods where retention is necessary to comply with legal obligations, to assert or defend against a legal claim, or for evidentiary purposes. Specific retention periods are available upon request.

10. International Transfers

TrustFully is a Missouri law firm serving clients in the United States. We do not routinely transfer personal information outside of the United States. To the extent any transfer of personal information to countries outside the United States occurs through our use of third-party service providers, we ensure that appropriate safeguards are in place as required by applicable law.

11. Your Data Protection Rights

Depending on your location and applicable law, you may have the following rights regarding your personal information:

  • Access: You may request access to the personal information we hold about you
  • Correction: You may request correction of inaccurate or incomplete personal information
  • Deletion: You may request deletion of your personal information, subject to our legal and professional responsibility retention obligations
  • Objection / Restriction: You may object to or request restriction of certain processing of your personal information
  • Portability: You may request that your personal information be provided to you in a portable, machine-readable format
  • Withdrawal of consent: Where we process your personal information on the basis of consent — including SMS consent — you may withdraw that consent at any time without affecting the lawfulness of processing prior to withdrawal

To exercise any of these rights, contact us using the information in Section 13. We respond to all requests in accordance with applicable data protection law. You may also have the right to lodge a complaint with a relevant supervisory authority.

SMS-specific rights: You have the right to opt out of SMS communications at any time without penalty and without affecting your ability to receive legal services from TrustFully. See Section 5 and Section 8 for opt-out instructions.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or by posting a notice on our website. We encourage you to review this page periodically for the latest information on our privacy practices.

Continued use of our Services after a policy update constitutes your acceptance of the updated policy. For changes that materially affect your SMS consent or opt-in status, we will seek fresh consent as required by applicable law and carrier requirements.
